Baroqoo will need to process users personal data to run our business and provide you with the services rendered throughout the website. By accepting our Terms of Use, you are confirming that you have read this policy and consent to us using your information in the ways described. Baroqoo, LLC is not responsible for the content, or the individual privacy policies of any of our members, websites hosted through third-party websites, or third-party applications. Users are responsible to abide by our policies when using the website. 

We provide the ability for some sellers, according to membership type, to link social media accounts and personal websites to their prospective shop/storefront. Baroqoo is not responsible, nor liable for any fraudulent activities deriving from the purchasing through those outlets.  By choosing to purchase away from Baroqoo's website directly, you forfeit any responsibility or action we might have had to resolve the issue presented. 

Baroqoo requires all account owners or account managers to be at least 18-years of age. By using the services, you authorize Baroqoo to use your information in the United States, and in all countries Baroqoo might operate in the near future.


User Information


To use the services, you will need to provide a valid email address, user name and address. This is to help prevent future fraudulent claims and for communication purposes.

Depending on the services that you choose to use (Buyer/Seller), we may collect additional information, such as billing or payment information, a telephone number, and a physical address. Your PayPal & Stripe keys to receive payments will also be used on our website. We have to link your payments account with your products to get you paid. All payment information and transactions are processed through third party applications; PayPal & Stripe respectively.

It should be known, the name associated with your Baroqoo account is publicly displayed. Other people (Anyone using or browsing the website) may see all material you have posted within the website. Baroqoo is not liable for what you post as a user. However, Baroqoo will monitor all traffic within the website. Baroqoo has the right to delete anything at any time we see fit which does not follow our policies and/or seen as hazardous to the website(s) environment.

Baroqoo will not sell or disclose your personal information to third parties without your consent, except as specified in our Privacy Policy. You agree that Baroqoo has the right to use your pictures, posts, shop names, and listings to promote your products and our services. This helps Baroqoo grow our community. In turn, it will help our users grow. Baroqoo will never claim anything posted by our users as our own. You may review and change your information in your account settings, and you may remove certain optional pieces of information at will.

As a Seller, Baroqoo may require information such as; identification ID or tax ID; bank account or credit card information. This includes any information needed to identify an individual. We may need to store credit card information and use it for both billing and payment purposes. This will be needed if you as a user request a 1099 tax form.

If you have chosen to connect your account to an external application (Facebook, Twitter, Instagram, etc.), you agree that Baroqoo is not responsible for any fraudulent activity on these platforms. You release Baroqoo from ANY action against us pertaining to your use on the above applications (See Social Media and Other Outlets).

If you believe that someone has misused or provided us with your personal information without consent, please contact us at hello@baroqoo.com.


Social Media & Other Outlets

Baroqoo is not liable for any action that takes place away from the website; or third party accounts. By you agreeing to the Terms of Use, you release Baroqoo from ANY action of unlawful activity. This includes identity theft or misuse of information. You are responsible for the personal information that you choose to post in community spaces through the Services.


Information Uses, Sharing & Disclosure

Baroqoo will not disclose your name, email address or other personal information to third parties without your consent, except as noted within our terms of use and policies.

As part of the buying and selling process, Baroqoo will facilitate the sharing of information between the two members involved in the transaction of sales, such as member's email address, shipping address, and payment information.

Baroqoo may release your personal information to a third party in response to lawful requests by public authorities. This includes all legal notices, debt collectors, court orders, or any claim brought on by an Attorney. Baroqoo will comply with the Law in all cases deemed necessary. Baroqoo will also release your information to authorities and collection agencies, if your use on our website resulted in any unlawful activity or non-payment.

Baroqoo needs to engage with third-party companies and individuals (i.e. PayPal, Stripe, Collections) to help us operate and provide the Services.

In some cases, Baroqoo may choose to buy or sell assets. If Baroqoo intends to transfer information about you, Baroqoo will notify you by email, or by website. Users will have the right to opt-out before the transfer takes place.

Baroqoo does not control the privacy policies of third parties, including other Baroqoo members’. Baroqoo is not responsible for the privacy or security practices of Baroqoo members or other websites on the Internet, even those linked to or from the Services provided.


Consent

When signing up to use the Services, you must consent and agree to ALL of Baroqoo’s policies and terms of use outlined.


Withdrawing Consent

You have the right to withdraw your consent to our processing of your information and your use of the Services. You can do this at any time by closing your account within your dashboard. If you’re having trouble closing your account, please contact us at, hello@baroqoo.com

User Security

It is important that you protect against unauthorized access to your account and information by choosing who you share this information with. Baroqoo is not responsible for fraudulent activity caused by use of the user either sharing, or, by giving unauthorized access to any third party applications, or baroqoo accounts. However, Baroqoo will attempt to help investigate any unlawful activity.

Baroqoo encrypts certain information (such as credit card numbers) using secure socket layer technology (SSL). These features are also used by PayPal & Stripe. Unfortunately, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.


Privacy Policy Changes

We may amend or update this policy from time-to-time. Baroqoo will strive to give at a minimum a 30-day notice to our users. We will give users the opportunity to consent to these changes.



Anti-Discrimination Policy

Baroqoo is to ensure no discrimination or harassment on the basis of race, color, religion, sex, sexual orientation, gender identity or expression, age, disability, marital status, citizenship, national origin, genetic information, or any other characteristic protected by law. Baroqoo prohibits any such discrimination or harassment.

Baroqoo Payments Policy

Baroqoo allows sellers to accept payment by authorized credit and debit card transactions (Stripe), or through PayPal. These payment processors charge fees to use their services. These fees can change from time to time without our immediate knowledge. It is up to the user to research and be aware of the fees, and any future changes.

*Note, Processing fees vary by country. See www.Paypal.com or www.Stripe.com for list of fees per country. Baroqoo has no control over third party processing fees.


Third-Party Services

Baroqoo partners with, PayPal & Stripe, to facilitate card payments and other payments and the disbursement of funds to sellers. The provider and processing time for your payment will vary based on the country and banking provider, in which you're located. Baroqoo may share your personal or transactional information with those third-party service providers when it's necessary to process payments.

By using a third-party service, you may also be subject to an agreement with the third-party. Please see PayPal User Agreement & https://stripe.com/us/legal.

Baroqoo’s Rights and Responsibilities

Baroqoo reserves the rights to terminate, cancel or suspend any shop, any product, or any transactions deemed necessary to keep our environment safe and legitimate. Baroqoo maintains records and does not pass any secure data, including credit card numbers or respective bank account information to any sellers. Sellers will only receive shipping information and limited buyer account information necessary to complete the order.

Seller Rights and Responsibilities

Baroqoo is not affiliated with PayPal or Stripe. As we do use these applications to operate our website, we are not responsible for any action against these processors. Users need to go directly to the above applications websites, and speak with a representative to solve issues on their end. Please note, PayPal & Stripe have their own policies you will need to abide by.

Disputes Sellers agree to resolve any disputes directly with a buyer or with the assistance of management in accordance with our Sellers Policy and Terms of Use.

International Trade Laws You agree that your use of PayPal & Stripe will not involve any countries, entities, individuals or items prohibited by any sanctions. See Sanctions Policy & Prohibited Items Policy. Please be aware that the Governments sanctions policy could be updated at anytime. You agree to the laws within the sanctions policy even if our list has not yet been updated to the most current policy. You agree that it is not our responsibility to keep the user proficient in these changes. However, Baroqoo will do its best to do so.

Deposits

Payment Account Baroqoo uses third party payment processors, such as PayPal & Stripe. Deposits made are determined by your dashboard set-up on these platforms, as well as your respective bank accounts. Baroqoo has no authority over how long these transaction could take.

Processing Fees

Overview PayPal & Stripe charges a fee (the “Payment Processing Fee”) for processing each transaction. The fee amount will be assessed on the gross order amount, including shipping and tax* (if applicable). The Payment Processing Fee will be deducted from the total amount of the payment at the time the payment is considered complete. *Taxes rest on the users shoulders. You agree Baroqoo is not liable for the taxes incurred on any sale. Please see your local laws pertaining to taxes.

Fee Amount Payment Processing Fees vary based on the location of a seller’s bank account. Payment Processing Fees by seller’s bank account country. Please see www.Paypal.com or www.Stripe.com for updated fee list. This list could change.

Sales and Returns You must pay for items purchased by you unless the seller has made a clear error or you cannot authenticate the seller’s identity. You and you alone are liable for paying the seller if you commit to buy an item.

You must post items purchased from you after receipt of payment in the time frame specified in the listing. All sales need to be reflected on quantity remaining. By not updating your item(s) the user is solely responsible to refund the buyer or make other arrangements.

All returns are subjected at the seller(s) discretion. If any issue arises in fraudulent activity, please contact Baroqoo immediately.

All sales are final unless posted otherwise by the seller(s).

Taxes Internal Revenue Service regulations require that we file a Form 1099-K to report unadjusted annual gross sales information for sellers located in the United States or being paid in USD that meet both of the following thresholds in a calendar year

A. More than $20,000 USD in gross sales, and B. More than 200 transactions.

If any of the above are met, sellers will be required to provide taxpayer-identification information to Baroqoo.

*You agree that it is not Baroqoo’s responsibility to report and hold tax for sellers. This is the sellers responsibilities only. Baroqoo has given the user the ability to collect taxes if they wish to do so. Baroqoo is not liable for current laws pertaining to the users nexus. 


Regarding the new 2019 Marketplace Facilitator Tax law: 

The law now affects (24) States and counting. Baroqoo, at the moment, is not considered to be within the perimeters of meeting criteria needed to facilitate this action. Please know that when the time comes, Baroqoo will need to collect taxes from certain states for our vendors. Baroqoo will then facilitate the tax withholdings and payable amount to such states on the vendors behalf.  Baroqoo will give a timely notice when it is time to do so. 


Sanctions Policy

There are countries and people who users are not allowed to conduct business with. It is the users’ responsibility to know this information when selling your items internationally.

If any potential seller(s) use our services that fall into one of these sanctioned countries, the user(s) will be banned from the website. Any legal action against these seller(s) or user(s) will be on the shoulders of the user(s). By agreeing to the terms of use, the user(s) releases any potential action against Baroqoo.

Economic sanctions are defined as the withdrawal of customary trade and financial relations for foreign and security policy purposes. They may be comprehensive, prohibiting commercial activity with regard to an entire country, like the long-standing U.S. embargo of Cuba, or they may be targeted, blocking transactions of and with particular businesses, groups, or individuals. Community Policy

  • You agree to be respectful to all.
  • You agree to abide by all Policies outlined in Terms of Use.
  • You agree that Baroqoo has the right to Cancel and Ban any Seller or Buyer from the website for not upholding the Policies and Terms of Use.
  • You agree that by purchasing items away from Baroqoo.com (I.e. In person, Social Media, or another website), even if these outlets are linked to our website by seller, you will lose buying protection. Baroqoo will not be able to provide support or refunds in these cases.



Sellers


Intellectual Property Policy

Intellectual Property, Trademark or Copyright infringement, rests solely on the shoulders of the user. Buyers and Sellers should be aware of what they post on our services. Anyone using our services agree to release Baroqoo of any lawful action against them or us in result of the users’ actions. Baroqoo reserves the right to terminate users that repeat the above infringements. If you believe someone has infringed against you, contact us at hello@baroqoo.com. Please provide all legal documents pertaining to the matter. This should include; registration numbers, patent numbers, and an official letter if available. Please note, without any legal documentation, or proof of such infringement, we recommend getting in contact with legal representation to help all parties properly resolve the matter as fast as possible.


Seller Protection Policy

If your shop, and or the order in question cannot be resolved through buyer & seller, Baroqoo will try to help you resolve the issue. Please note, Baroqoo cannot guarantee a satisfactory resolution. Baroqoo will attempt to do everything we can, including issuing partial or full refunds. However, all policies and terms of use guidelines would need to be met for the above to be considered.


Overview of Fees & Payments Policy


1. Types of Fees

Transaction Fees

Baroqoo currently has two types of memberships. We will charge a set monthly fee, or/and charge a commission fee.

  • When you make a sale through Baroqoo.com, you will be charged a transaction fee of 3.0% of the price you display for each listing. This is the total cost of the item. Including shipping and tax (If applicable).
  • Monthly fees can change at anytime Baroqoo feels the need. This will be determined by many factors and costs associated with the website.
  • Users will be given at a minimum of 30-day notice of any changes.

Transaction Fees

Payment processing fees vary based on the location of your bank account. See fees at, www.Paypal.com or www.Stripe.com to find payment processing fees by country. This fee is assessed on the total amount of the sale, including tax and shipping. Fees start at 2.9% +0.30 per transaction. Fees are determined by country.

Other Fees

Baroqoo offers Promoted Listings. If you advertise through Promoted Listings, you will be charged a separate fee. This fee will be posted before purchase. These are listed in form as "Featured" items and/or shops. These fees can change at anytime without notice. 

Monthly Membership Fee/Refunds

Monthly membership fee will be deducted once a month based on the time and day of sign up. This is a reoccurring fee. We reserve the right at any time to increase, decrease, or cease the fee. Users will have the right to cancel membership at any time, for any reason.

By enrolling in Auto Billing automatic payment plan, your fees will be charged to the credit card or PayPal account you have on file. To use the plan, you agree to the following terms.

  • You authorize Baroqoo to keep your payment card information on file and to charge the card on file on the enrollment day of each calendar month for the previous month’s outstanding charges and at any time the balance was not paid.
  • You may cancel Auto Billing at any time. Baroqoo requires a reasonable period of time to act after we receive your notice. There are no partial refunds. Your billing will stop at end of paid period. This means if you cancel middle month, you will still have the rest of month to continue your shop. **Assuming you cancel PayPal and not close shop.
  • If you cancel a shop, please know that canceling will only cancel your shop, not your PayPal subscription. Closing a shop is a Two-Step process. Either close the shop and then cancel PayPal separately or, Cancel PayPal and you will have until it expires and the shop will close.

Taxes

You are responsible for collecting and paying any taxes associated with using and making sales through Baroqoo’s services. If you sell physical goods on Baroqoo and reside in the US or Canada, you have the option of either including applicable taxes in your listing prices, or excluding applicable taxes from your listing prices. If you sell physical goods on Baroqoo and reside outside of the US and Canada, you need to include all applicable taxes in your listing prices.

Please remember that Baroqoo fees do not include any withholding taxes that might apply in your home country. Taxes rest on the shoulders of the User! You agree and release Baroqoo from any audit you have in result of not paying taxes.

Cottage Laws (Selling food or edible goods)

Cottage Foods Act. The Cottage Foods Act allows limited types of food products that are non-potentially hazardous (do not require refrigeration for safety) to be sold directly to consumers without licensing or inspection. 

By selling edible goods on Baroqoo, the user agrees to know his/her laws pertaining to the sell of such items. Please note that each state varies.


Hazardous or Cancer causing materials/products

By agreeing to these Terms, the user is responsible for any action taken, or cause of damage arising from any product associated with harmful effects. Baroqoo is not responsible for the damages caused by ANY product sold through the marketplace. This includes, but not limited to; Cancer, Sickness, Bodily Injury, Personal Defects, loss of life, deformities. The user (Buyer & Seller) release Baroqoo from any legal action pertaining to the above.




Handmade Policy

1.Selling Handmade Items

Everything listed as handmade must be made and/or designed by you, the seller. If you are a designer, and have outsourced help to create such a product, you will need to advertise as such. We reserve the right to delete, and or refuse items to be listed on any of Baroqoo’s services. Baroqoo has the final say! 

2. Vintage Items

Baroqoo lets users sell certain vintage items. The product(s) are considered vintage vintage of at least 20+ years of age. Vintage items are unfortunately left to be very subjective in nature. Baroqoo will do its best to identify if something is deemed vintage or not. We do reserve the right to dismiss any claim of a vintage item.

3. Being Honest

Users agree to honestly and accurately represent yourself, your items, and your business.

4. Refunds within this policy

By agreeing to the terms of use, users are agreeing to all policies within. If a user opens an account with items that do not abide by this policy, the user will forfeit the monthly membership fee, and not be reimbursed if the user chooses to cancel membership.


Drop-shipping Policy


We understand this makes it easier for the seller to handle inventory and get their designs to market.  Baroqoo will allow drop shipping if the items listed are the users own handmade design. This is used solely for artwork and graphic design.

No other drop shipping products are allowed. If the user utilizes the above, he or she will need to state this clearly in each listing so the buyer is aware. 




Prohibited Items Policy

The following types of items are prohibited or restricted on Baroqoo.

  • Hate Items
  • Animal Products and Human Remains (certain items are allowed, i.e. leather bags)
  • Violent Items
  • Hazardous Materials
  • Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs
  • Weapons
  • Illegal Items
  • Internationally Regulated Items (Be aware of your countries laws)
  • Dangerous Items of any sort
  • Prohibited items examples are below, however not exhaustive. If you have any questions or concerns about your product or another's, contact us at the below email.
  • Adult items, including pornography
  • Alcohol • Animals and Wildlife products
  • Cosmetics - manufactured
  • Drop shipping your products (UNLESS clearly defined and stated in listing) Artwork & Graphic design ONLY
  • Drugs and drug paraphernalia
  • Electronics equipment
  • Firearms, weapons, and knives (We accept artifacts and cookware)
  • Hazardous, restricted, or regulated materials • Human remains and body parts
  • Medical drugs, devices, and healthcare • Offensive material (subjective)
  • Profanity - Please do not use offensive words
  • Recalled items
  • Stolen property
  • Tobacco
  • Wholesale goods
  • Anything not within our handmade policy

We reserve the right to remove listings that we determine are not within the spirit of Baroqoo. Such listings will be removed from the site, and the member's selling privileges may be suspended and/or terminated.

If you see something on Baroqoo that appears to violate these rules, you can report it to us. This will in turn help the Baroqoo community.
